Workers Compensation

WHAT IS WORKERS COMPENSATION?  It is an insurance plan provided by your employer that pays medical costs for treatment to you if you get hurt or become sick because of conditions on your job.  Your employer must pay for this insurance, and you are not required to pay for any part of it.  This insurance also provides payment to you for part of your lost wages if an injury or illness disables you for more than 7 days. 

IS MY EMPLOYER REQUIRED TO HAVE WORKERS COMPENSATION INSURANCE?  Most employers who have 4 or more employees are required to have workers compensation coverage.  Employers in the construction industry are required to have coverage if they have at least 1 employee. 

IS THERE A TIME LIMIT FOR ME TO MAKE A CLAIM?  There are many factors that affect the time limit, or statute of limitations, and each situation must be evaluated closely.  You have 30 days to report your injury to your employer if you are injured at work .  Generally, you have 2 years from the date of the accident to file a claim.  Failure to report your accident within 30 days may be used as a defense, regardless of the 2 year statute of limitations for filing a claim.

HOW AM I PAID, AND HOW MUCH WILL I GET IF I CANNOT WORK?  You will not be paid for the first 7 days you miss unless you miss more than 21 days.  As long as your approved treating doctor says you cannot work because of your injury, you should receive checks every 2 weeks.  In most cases, you will receive 2/3 of your regular pay, up to the state maximum.

DO I HAVE TO PAY ANY OF THE MEDICAL BILLS?  Your employer or its workers compensation insurance company must pay for approved and medically necessary care.  Once you reach maximum medical improvement you are required to pay a $10.00 co-payment per visit for medical treatment.

CAN I CHOOSE MY OWN DOCTOR?  Your employer or the workers compensation insurance company must provide you with an approved doctor.  If you need to make changes, contact your employer or the insurance company.  If you believe you need to make a change and you are prevented from changing doctors, we may be able to help you.  Call us for a free consultation.
